Welcome to the EVeium website. These terms and conditions ("Terms of Sale", “Terms”, “Sale Terms”) are applicable to the products available for sale on the website.

For the purpose of these Terms of Sale, wherever the context so requires "You" or "User" shall refer both to you as an individual and to the entity you represent and visiting and/or using website.

If you purchased an electric vehicle from us, you represent and warrant to Company that You are 18 years of age or older, and that You have the right, authority, and capacity to use the Website and agree to and abide by these Terms of Sale. You also represent and warrant to the Company that You are responsible for registering and using the Products you purchased in accordance with any and all applicable laws and regulations.

You accept full and complete responsibility for all use of any electric vehicle or other Product and you also are representing and certifying to us that you understand the nature of riding and/or driving an electric vehicle and associated activities, that you are qualified and legally permitted to operate said electric vehicle, and that you are in proper physical condition to participate in such activity. If you are not familiar with the nature of riding and/or driving an electric vehicle, you should seek professional training and obtain necessary permit from governing authority before operating an electric vehicle.

Pricing Information

Prices offered on the Website are quoted in Indian Rupees (INR). Such prices do not include taxes (GST or/and any applicable taxes), Vehicle Registration Charges (RTA), Insurance, and any other additional services expenses.

Placing Orders

You must follow the instructions and popups/prompts on the website to place your orders. By placing the order on the website you are committing to purchase the product(s).

Once an order is placed, it is subject to our acceptance. Ellysium has right to refuse any orders, at any time after receipt of your order, or any part of any order, for any reason without any liability to you (other than a refund of any charge made in respect of such order). Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order. We may require additional verifications or information before accepting any order.

After your order is placed and if it is accepted Ellysium will send you an email confirmation within 10 business days and provide you with an order confirmation number.

Product Availability

Any Product displayed on our website does not imply or guarantee that it will be available at the time you place an order. Products are subject to availability, and we reserve the right to impose quantity limits on any order, to reject all or part of an order, and to discontinue offering certain Products, all for any reason whatsoever and with no liability to you or any third party.

We have made every effort to display the colors of our products that appear on the Site as accurately as possible. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will be accurate.

Order Payments

Ellysium accepts payments made by credit/debit card or/and any other method of payment specified at the time of checkout on the website; Any other mode of payments is not accepted for the orders placed through the website.

You agree, understand, and confirm that the credit/debit card details or other acceptable payment method provided by you to purchase product(s) on Website will be correct and accurate. You shall not use the credit/debit card which is not lawfully owned by you. You further agree and undertake to provide your correct and valid details to process your order on website.

If at any time your payment method and information cannot be verified, or is invalid, or is otherwise not accepted, Ellysium will suspend completion of your order until we are able to resolve the issue to our satisfaction.

Ellysium will not be liable for any transaction fraud done via credit/debit card or any other payment method. The liability for payment method fraudulently will be exclusively on you.

Refunds and Exchanges

All sales are final, and no refunds or exchanges for Products purchased through this Website will be made except as described in these Sale Terms.
Customers are eligible to get a full refund of the booking amount. However, the customers won’t be eligible to request refunds on the payment towards the purchase of the vehicle.
It must be noted that all eligible refunds will be processed within a period of 14 working days.

Shipping and Delivery

For all accepted orders placed though the website, Ellysium will ship the order to the authorized dealer showroom or/and service center located in your city of residence or near to your city of residence whichever is selected by you. At the time of placing order you must select location of order pickup from the list of authorized dealer(s).

You are responsible to collect your order, promptly inspect your products, and report any damages or other issues to Ellysium. Delivery dates are approximate and are dependent upon (1) receipt of all your information necessary to process the order, (2) your compliance with all of the payment terms, and (3) your compliance with all terms, obligations, covenants, and conditions of these Sale Terms.

Subject to stock availability, our standard delivery time is three (3) weeks from the date of order acceptance. In the event of no stock availability of ordered product, Ellysium sales representative will call you to provide tentative date of product availability. If you encounter any problems with a delivery or shipment, you should contact us immediately at sales@ellysiumauto.com

Indemnification

You agree to indemnify and hold us and our parents, subsidiaries, affiliates, officers, employees, agents, partners, and licensors (if any) harmless from any claim or demand, including reasonable attorneys' fees, due to or arising out of your: (a) use of the service; (b) violation of this Agreement or any law or regulation; or (c) violation of any right of a third party.

Severability

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, if you breach these terms and we take no action, we will still be authorized to use our rights and remedies in any other situation of any subsequent breach.

Amendments to these Terms of Sale

We reserve the right. at its sole discretion, to modify or replace these terms at any time. Any update, revision, supplementation, modification, or amendment will be effective immediately upon its posting on the website. What constitutes a material change will be determined at our sole discretion. You understand and agree that your purchase of any Products after any posted update to these Sale Terms indicates your acceptance of these Sale Terms as updated, even if you did not take the time to read them. Force Majeure

In no event will Ellysium be liable for non-delivery or delays in delivery of any Products or for failure or delay in the performance of any other obligations contained in these Sale Terms or otherwise on the Site arising directly or indirectly from matters beyond our reasonable control, including acts of God, unforeseeable circumstances, acts (including delays or failure to act) of any governmental authority, war (declared or undeclared), riot, revolution, priorities, fires, floods, weather, strikes, labor disputes, sabotage, epidemics, factory shutdowns or alterations, embargoes, delays or shortages in transportation, delay or inability to obtain or procure labor, manufacturing facilities, or materials, or any inability to obtain timely instructions or information from you.

Governing Law and Jurisdiction

These conditions mentioned along with other policies i.e. Privacy Policy, Terms of Use and all other company policies are governed by and construed in accordance with the laws of India under the jurisdiction of Courts of New Delhi or Hyderabad alone

UNDER ANY CIRCUMSTANCES OR/EVENT SHALL ELLYSIUM AUTOMOTIVES PRIVATE LIMITED BE LIABLE FOR ANY EXCEPTIONAL, INCIDENTAL, INDIRECT OR FAR-REACHING DAMAGES OF ANY KIND IN CONNECTION WITH THESE TERMS OF SALE, EVEN IF USER HAS BEEN INFORMED WELL IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES.

Typographical Errors

We strive to provide accurate Product description and pricing information, but we do not guarantee that the Product description and pricing information are accurate, complete, reliable, current, or error free. In the event a product and/or service is listed at an incorrect price or with incorrect information due to typographical error, we shall have the right to refuse or cancel any orders placed for the product and/ or service listed at the incorrect price. We shall have the right to refuse or cancel any such order whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we shall immediately issue a credit to your credit card account or other payment account in the amount of the charge without any deductions.

Miscellaneous

If for any reason a court of competent jurisdiction finds any provision or portion of these Terms to be unenforceable, the remainder of these Terms will continue in full force and effect.
